Terms of Use

1. Platform use

Deal Desk Funding provides a platform to submit real estate transactions for funding review, share transaction documents, and coordinate with capital providers and transaction parties.

2. Eligibility

You must be at least 18 years old and able to enter into binding agreements. The platform is intended for business and investment real estate transactions, not personal, family or household purposes.

3. Accurate information

You agree that information and documents you submit are accurate, complete and not misleading, and you will update them if they change.

4. Authority to submit

You confirm you are authorized to submit the transaction information and documents you provide, including on behalf of any entity you represent.

5. Electronic communications

You agree to receive communications electronically, including by email, and that electronic acknowledgments and authorizations you complete on the platform are valid.

6. Permission to verify

You authorize Deal Desk to verify transaction information, including by contacting title or escrow companies, counterparties and other transaction parties.

7. Sharing with capital providers

You authorize Deal Desk to share relevant transaction information and documents with capital providers selected for your transaction and with transaction parties, as described in our Privacy Policy.

8. No guarantee of approval or funding

• Submitting a transaction does not constitute an offer, commitment or approval of funding.
• There is no guarantee that any transaction will be approved or funded.
• Deal Desk Funding is not the direct lender or funder unless explicitly identified as such in writing for a specific transaction.
• All funding decisions remain subject to the capital provider's underwriting and transaction-specific documentation.
• Readiness indicators on the platform (such as “Ready for Funding Review”) are not approvals.

9. Prohibited misuse

• Submitting false, forged or altered documents or information.
• Using the platform for fraudulent or unlawful transactions.
• Attempting to access deals, documents or accounts you are not authorized to access, or sharing private links with unauthorized people.
• Interfering with or attempting to bypass the platform's security.

10. Intellectual property

The platform, its design and content belong to Deal Desk Funding. You keep ownership of the documents you upload and grant us permission to use them to provide the services.

11. Service availability

We aim to keep the platform available but do not guarantee uninterrupted or error-free service. We may change or discontinue features.

12. Limitation of liability

To the extent permitted by law, Deal Desk is not liable for indirect or consequential losses, or for decisions made by capital providers or transaction parties.

13. Governing law and disputes

14. Changes to these terms

We may update these terms. The "last updated" date shows the latest version; continued use means you accept the updated terms.
